02/04.08.2014 An urgency slip was filed by the counsel for the applicant and therefore, the matter has been listed today.
Heard the learned counsel appearing for the parties and perused the documents on record.
The applicant is apprehending his arrest in connection with G (F) No. 426 of 2013 registered under Sections 33, 41, 42 of the Indian Forest Act.
The learned counsel appearing for the applicant submits that applicant is the owner of the truck on which “Poda Coal” was found loaded. It is further submitted that the minimum punishment prescribed for offence as alleged is six months and under Section 2(iv) of the Indian Forest Act “Poda Coal” does not fall within the definition of forest produce.
The learned A.P.P. opposed the prayer for grant of anticipatory bail.
Considering the facts and circumstances of the case, in the event of arrest of the applicant or if he surrenders before the trial court within a period of four weeks from today, the applicant namely, Anis Ahmad would be released on bail on furnishing bail bond of Rs. 10,000/ (Ten thousand) with two
sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribag in connection with G (F) Case No. 426 of 2013.
Let a copy of this order be sent through FAX to the concerned trial court on depositing the cost by the applicant.
