02/04.08.2014 An urgency slip was filed by the counsel for the applicant and therefore, the matter has been listed today.

Heard the learned counsel appearing for the parties and perused the documents on record.

The applicants are apprehending their arrest in connection with C.F. Case No. 23/11 registered under Section 33 of the Indian Forest Act and Sections 17(K) m, 27, 29, 30, 31 of the Wild Life Protection Act.

The learned senior counsel appearing for the applicants submits that 15 decimals of land was settled in favour of the applicants by the ex-landlord by a Hukumnama and when they were clearing the land, on the allegation that they were illegally felling trees, a first information report has been lodged. It is further submitted that though there is no seizure list on record and only the applicant no. 2 is said to be seen fleeing away from the place of occurrence, all the three applicants have falsely been implicated in the present case. The minimum punishment for the offence as alleged is six months.

The learned A.P.P. opposed the prayer for grant of

anticipatory bail.

Considering the facts and circumstances of the case, in the event of arrest of the applicants or if they surrenders before the trial court within a period of four weeks from today, the applicants namely, 1. Suku Nagesia @ Shukhu Nagesia, 2. Jagdish Nagesia and 3. Bhagat Nagesia would be released on bail on furnishing bail bond of Rs. 10,000/ (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Latehar in connection with C.F. Case No. 23/11.

Let a copy of this order be sent through FAX to the concerned trial court on depositing the cost by the applicants.
