ORDER
- The Appricant Bank fired the present oA against Defendants for recovery of a total sum of Rs.1,25,62,g24.34 pS (Rupees One Crores Twenty Five Lakhs Sixty Two Thousand Eight Hundred Twenty Four and paise Thirty Four Only) together with future interest @ 9.60% (7.60% + 2o/o penat) p.a with monthly rests from the date of filing of OA till the date of realization and in default for sale of Mortgage property as mentioned in the Schedule to OA.

with future interest @ 9.60% p.a with monthry rests and the defendants executed Home Loan Agreement dated 20.09.2023 in favor of the appricant bank. The Defendants arso created Mortgage morefuily mentioned in schedure to oA and executed original Registered sare Deed no.6679t2023 dated 20.10.2023 in favor of the Applicant Bank. After availing the loan facilities, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NpA on 0g.06.2025 and issued Demand notice on 10.06.2025. rnspite of severar requests and demands, the defendants did not clear the outstanding. Hence this OA.

4.12. ln view of the above, I hold that the Applicant Bank has estabrished their craim made in the oA against the Defendants and hence the Appricant Bank is entifled to recover the craim made in the OA with future interest and costs.
The Defendant nos. 1 and 2 are joinfly and severally liable to pay to the Applicant Bank a total sum of Rs.1,25,62,g24.34 pS (Rupees One Crores Twenty Five Lakhs Sixty Two Thousand Eight Hundred Twenty Four and paise Thifi Four Only) together with future interest @9.60% p.a from the date of firing of OA till the date of realization.
