executed Housing Loan Agreement dated 21.10.2022. The defendants created mortgage morefully mentioned to schedule A to oA by executing Necessary documents in favor of the appricant bank. After avairing the roan facirities, the defendant faired to comply the terms of sanction, hence the appricant bank classified the account as NpA and issued Legal notice on 30.01.2025. lnspite of severar requests and demands, the defendants did not clear the outstanding. Hence this OA.
Defendant called absent and set exparte on 09.09.2025.
Sri. Banoth Manthu, Authorized Officer of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.9.
Heard the Ld. Counsel for the Applicant Bank.
- The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?
Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, offtciat of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.9. ln view of the above, I hold that the Applicant Bank has their claim made in the OA against the Defendant and

hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.
ln the result, the present oA is allowed with costs, as under:
- The Defendants are joinfly and severalry liable to pay to the Applicant Bank a total sum of Rs.7g,g2 ,12gt- (Rupees seventy Eight Lakhs Eighty Two Thousand one Hundred and rwenty Eight Only) under Housing Loan together with the future interest @10.90%p.a from 01 .0s.2025 till the date of reatization.
