The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.24,55,368/- (Rupees Twenty Four Lakhs Fifty Five Thousand Three Hundred and Sixty Eight Only) under term loan account Nos. 4094333958 at amount Rs.20,19,253/- and 40980522874 at amount Rs. 4,36,115/together with the future interest @11.20% p.a from the date of filing of this application till the date of realization.

As per the averments in the application, the Applicant Bank states that defendant availed term loan under its personal loan Schemq({-ptgss Credit Facility) of Rs.25 Lakhs with interest @ 11.20o/o p a wh-rch repayable in 72 equal monthly installments of Rs.47,8421- ,,,4nd the defendant executed personal loan n^', : ^ itll t l ' :'.. 2 U

Agreement dated 27.04.2022 in favor of the applicant bank. The Defendant avaired another term roan under under its personar loan Scheme(X-press Credit Facility) of Rs.5,23,000/_ with interest @ 11.20% p.a which repayable in 72 equat monthty installments of Rs.10,009/- and the defendant executed personal loan Agreement dated 10.05.2022. After availing the loan facilities, the defendant faired to compry the terms of sanction, hence the applicant bank classified the account as NpA on 12.11.2024 and issued legal notice on 2g.06.2025. tnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendant called absent and set exparte on 23.10.2025.

Smt. Kalyani Rathod, Manage(CCO) of the Appticant Bank examined herself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.11

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

A.11. ln view of the above, I hold that the Applicant Bank has established their claim made in the oA against the Defendant and hence the Applicant Bank is entifled to recover the craim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under :

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.24,55,368/- (Rupees Twenty Four Lakhs Fifty Five Thousand Three Hundred and Sixty Eight Only) together with the future interest @11.20Yo p.a from the date of application till the date of realization.

The Applicant Bank is also entifled to proceed against the person and properties of defendant towards realization of the debt due.

That Applicant Bank is entifled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

lssue Recovery Certificate accordingly.

Communicate a^copy of the order to the parties concerned.
