The Applicant Bank filed the present oA against Defendant for sum of Rs.45,05,869/- (Rupees Fofi Five Eight Hundred and Sixty Eight Onty) i.e

(i) Rs.36,91,535.00 PS (Rupees Thirty Six Lakhs Ninety One Thousand Five Hundred and Thirty Five Only) in respect of the term loan (A/c no. 38719302256), together with future interest @13.40%^{p.a with monthly rests from 01.07.2025} titl the date of realization.

(ii) Rs.4,94,368.00 PS (Rupees Four Lakhs Ninety Four Thousand Three Hundred and Sixty Eight Only) in respect of the GECL loan (A/c no. 40646328188), together with future interest @10.90o/o p.a with monthly rests from 01.07.2025 till the date of realization.

(iii) Rs.3,f 9,965.00 PS (Rupees Three Lakhs Nineteen Thousand Nine Hundred and Sixty Five Only) in respect of the GECL Extension loan (A/c no. 39363820002), together with future interest @10.90% p.a with monthly rests from 01.07.2025 till the date of realization.

As per the averments in the application, the Applicant Bank states is a partnership firm and Defendant nos. 2 The applicant contended that defendant Nos. 2 and 3 availed term loan h credit facility of Rs.2 Lakhs and the

defendants executed Agreement of Loan cum Hypothecation dated 14.08.2025 in favor of the applicant bank. The said loan facilities were renewed from time to time. The defendant nos. 2 and 3 on behalf of Defendant no. 1 availed additional facility under GECL-WCTL of Rs.11 lakhs and executed Agreement of Loan cum Hypothecation dated 30.05.2020. The defendant nos. 2 and 3 on behalf of Defendant no. 1 availed extension GECL-WCTL of Rs.5.70 lakhs and executed Agreement of Loan cum Hypothecation dated 27.12.2021. After availing the loan facilities, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 30.10.2024 and issued legal notice on 16.06.2025. lnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendants called absent and set exparte on 06.10.2025.

Sri. P. Prabhakar, Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.18.

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1 , otficial of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to 4.18. ln view of the above, ! hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

!n the result, the present oA is allowed with costs, as under:

The Defendant nos. 1 to 3 are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.45,0s,B6g/- (Rupees Forty Five Lakhs Five Thousand Eight Hundred and sixty Eight Only) i.e a sum of -

(i) Rs.36,9{,535.00 PS (Rupees Thirty six Lakhs Ninety one Thousand Five Hundred and Thirty Five Only) in respect of the term loan (A/c no. 38719302256), together with future interest @13.40%^{p.a from 01.07.2025 till the date} of realization.

GECL Extension loan (A/c no. 39363820002), together with future interest @10.90% p.a from 01.07.2025 till the date of realization.

L The Applicant Bank is entitled to proceed against the Hypothecated Movables mentioned in the Schedule to the OA towards realization of the debt due.

The Applicant Bank is also entitled to proceed against the person and properties of defendant nos.2 and 3 and the properties of Defendant no. 1 towards realization of the debt due.

That Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

lssue Recovery Certificate accordingly.

Communicate a copy of the order to the^parties concerned.
