ORDER

The Applicant Bank filed the present OA against Defendants for recovery of a total sum of Rs.20,95,i31l- (Rupees Twenty Lakhs Ninety Five Thousand One Hundred and Thirty One Only) together with future interest @ 9.60% p.a with monthly rests with from the date of filing of application till the date of realization and in default for sale of Mortgage property as mentioned in the Schedule to OA.

As per the averments in the application, the Applicant Bank states defendant availed Home Loan of Rs.17.90 Lakhs and the defendant executed Home loan Agreement dated 25.11.2021 in favor of the applicant bank The defendant created equitable mortgage morefully mentioned in Schedule to OA. After availing the loan facilities, the defendant failed to comply the terms of sanction, hence the applicant bank classified the account as NpA on 01.01.2024 and issued Demand notice on 23.02.2024 under Section 13(2) of SARFAEST Act,2OO2. tnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Mr. Abhishek Naini, Asst. General Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.'l to A.8.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Appticant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.g. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and hence the Applicant Bank is entifled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under :

The Defendant is jointly and severally liable to pay to the Applicant Bank a total sum of Rs.20,95,131/- (Rupees Twenty Lakhs Ninety Five Thousand One Hundred and Thirty One with future interest @ 9.60% p.a with from the tion till the date of realization.

The Applicant Bank is entifled to proceed against the Mortgage Property mentioned in the Schedule to the OA towards realization of the debt due.

The Applicant Bank is also entitled to proceed against the person and properties of defendant towards realization of the debt due.

That Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

lssue Recovery Certificate accordingly.

Communicate a copy of the order to the parties concerned.
