1' The Applicant Bank fired the present oA against Defendant nos. 1 and 2 lor recovery of a total sum of Rs.66,27,0g4.00/_ (Rupees Sixty Six Lakhs Twenty Seven Thousand and Eighty Four Only) i.e
(i) Rs.32,68,311.00 (Rupees Thirty Two Lakhs Sixty Eight Thousand Three Hundred and Seventy Seven only) under Loan A'/c No. 0002575100095646 with future interest from the date of fiting of this oA @ g.os% p.a. with monthry rests tiil the date of realization;

(ii) Rs.32,874.00.00 (Rupees Thirty Two Thousand Eight Hundred and Seventy Four only) under Loan A"/c No. 0002675100095725 with future interest from the date of filing of this OA @ 9.05% p.a. with monthty rests tiil the date of reatization;
(iii) Rs.32,92,514.00.00 (Rupees Thirty Two Lakhs Ninety Two Thousand Five Hundred and Fourteen only) under Loan A,/c No. 1325675100007986 with future interest from the date of filing of this OA @ 10.55% p.a. with monthty rests tiil the date of realization;
(iv) Rs.33,319.00 (Rupees Thifi Three Thousand Three Hundred and Nineteen only) under Loan Nc No. 0002675100096292 with future interest @ 9.0S% p.a. with monthly rests from the date of filing of this OA till the date of realization;
And in default for sale of Mortgaged Properties as mentioned in the Schedule Properties I and ll to OA.

availed home loan of Rs.2g.00 Lahks with interest @ g.45o/o p.a with monthly rests repayable in equated monthly installments of Rs.29,154/- each arong with interest and costs and executed Home Loan Agreement on 21 .11.2022 and created mortgage in respect of the schedure il property to oA in favor of the appricant bank. After avairing the roan facilities, the defendants faired to compry the terms of sanction, hence the appricant bank crassified the account as NpA and issued legal notice on 26.04.2024. lnspite of severar requests and demands, the defendants did not clear the outstanding. Hence this OA.
Defendant called absent and set exparte on 22.10.2025.
Sri, Abhishek Naini, Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 lo A.21.
- The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendants as prayed for?
Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to 4.21. ln view of the above, I hold that the Applicant Bank has ,:,

established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.
