It is observed that a letter dated 15/03/2023 mentioning therein about online filing of waiver petition as per order dated 09/03/2023 along with receipt of requisite fee ofRs.250/- vide Transaction Ref. Id. 260223001170 dated 26/02/2023 was received on 20/03/2023 from Ld. Counsel Mr. Sarosh Bastawala for Appellant towards removal of remaining defect in pursuance of order dated 09/03/2023.The waiver application is numbered being IA/126/2023.
Hard copy ofthe above waiver application was received by post on 28/02/2023 without requisite fee and it was not filed through online in terms of Ministry of Finance, Gazette Notification dated 31/01/2023. Accordingly, Ld. Counsel was directed vide order dated 09/03/2023to file the waiver application through online with requisite fee.
This appeal being Dy. No. 63 of 2023 was filed on 27/01/2023. On scrutiny four numbers of defects were found and an order was issued in this regard on 30/01/2023. In compliance of the order, Ld. Counsel for appellant has rectified all the defectsexcept defect at Sl. No. (iv), on 21/02/2023.
Hence all the defects mentioned in order dated 30/01/2023 have been removed by the Ld. Counsel of Appellant.
The matter may be placed before Hon’ble Chairperson on 27/03/2023 for admission.
