Ld. Counsel Mrs. Gitasree Chattopadhyay is present for Respondent No.1and files fresh affidavit of service as directed in order dated 13/03/2023.It is seen from postal tracking report that service upon Appellantis confirmed. Ld. Counsel also states in the said affidavit that “service upon the Respondent No. 2 is not required because the prayer is made in the petition is against the Appellant and not against the Respondent No. 2, moreover service of any application or any documents is required to be made on the other side and not on the same side who are on the same footing, thereby service of the petition has not been made against the Respondent No. 2”.

None appears for Appellant and another Respondent No. 2.

Received this petition being No. IA/94/2023 through online on 25/02/2023 filed by Ld. Counsel Ms. Mekhala Kanji for Respondent No. 1 with a request for modification of the order dated 14/02/2023 passed by Hon’ble Chairperson. Hard copy of the same was received on 28/02/2023. Affidavit of service was not filed along with the petition.
