A mention has been made on behalf of the learned counsel for the appellant that the arguing counsel Shri Sundeep Agrawal is busy before the Hon’ble High Court, therefore, he is unable to appear before this Tribunal today, hence he seeks adjournment.
Learned counsel for the respondent-Bank states that the appeal is filed by the purchaser of the mortgaged property and the borrower in terms of one time settlement has deposited the entire amount and the matter has been settled and papers have also been returned to him as it has also been stated by the counsel for the appellant in para 6 of the I.A. No. 207/2023, therefore, the present appeal has become infructuous, hence the same may be dismissed as such.
Since the counsel for the appellant Shri Sundeep Agrawal is not present today, therefore, list this case on 23.05.2023.
