Heard the learned counsel for the appellant on the urgency application being I.A. No. 375/2023, which has been filed on the ground that the auction purchaser is creating pressure to handover the physical possession of the auctioned property as he has deposited entire sale amount. Vide order dated 01.02.2023, the entire sale has been set aside by the Tribunal below, which is under challenge in the present appeal. The next date is already fixed for 10.08.2023.
In view of the above, there is no good ground made out in the urgency application for expediting the matter. Hence, the same is rejected.
However, the counsel for the appellant may take steps within 10 days for service of notice upon the respondents by two modes i.e. registered post with A.D. and Speed post.
Let the case be listed on the date already fixed for 10.08.2023.
