The Appellant who is present in person, agrees that he is willing to cooperate with Respondent Bank to proceed with the sale of secured assets as long as he is provided with the amount that is due to him as mentioned in the e-mail which has been sent by the bank and accepted by the Appellant.
Under the circumstances, the Respondent is given the liberty to proceed with the sale with the cooperation of the Appellant, and consequent to the sale and the settlement of the amount to be received by the Appellant, he is willing to withdraw the Appeal.
Recording this statement made by the Appellant in person and the learned counsel appearing for the Bank across the Bar, the Appeal is posted on 07.02.2023 for reporting progress.
