The present petition has been filed alleging wilful and deliberate disobedience of the order dated 15^th September, 2022, passed by this Court, in FAO 233/2019 , wherein, a Settlement-cum-Compromise Deed (“Settlement”) dated 15^th October, 2019, arrived at between the parties, was recorded.

Learned counsel appearing for the petitioner submits that in terms of the said Settlement, the petitioner had paid a sum of Rs. 50,000/- to the respondent.

He submits that despite receiving the said amount, the criminal complaint pending in the Court Chief Judicial Magistrate (“CJM”), of Raebareli, Uttar Pradesh, was not withdrawn by the respondent, on account of which, the present petition has been filed.

The respondent Mr. Daya Shankar Panday, is present in Court. He submits that he is satisfied with the Settlement and he will not file any other case against the petitioner, which is subject matter of the Settlement dated 15^th October, 2019.
