compliance of the directions issued to the Municipal Corporation of Delhi (“MCD”), as it failed to take action against the unauthorized construction in various properties, which are the subject matter of the said petitions.

The contempt petition being CONT.CAS(C) 1204/2022, pertains to the properties bearing nos. B-143, B-147, A-126, and A-46, Panchsheel Vihar, New Delhi-110017. On the other hand, in CONT.CAS(C) 1355/2024 and CONT.CAS(C) 350/2025, the subject properties are the properties located at Village Shekh Sarai, New Delhi , Panchsheel Vihar, Delhi and Village Khidki, Malviya Nagar, New Delhi.

During the course of hearing, very shocking facts have been revealed to this Court, which show that a scam is being run by a set of people, wherein, they file petitions for the purpose of extorting money from the people, in whose properties, some unauthorized construction is existing.

Perusal of the aforesaid Compliance Report clearly shows a nexus amongst different persons, for the purposes of misusing the process of the Court by obtaining orders for demolition of the properties, and then approaching their owners, in order to take extort money from them.

Mr. Narayan Kumar Kashyap is present in Court, who was the signatory of the Public Interest Litigation (“PIL”) being W.P.(C) 14313/2022 , under the name of Universal Human Right Foundation.

He submits that one Mr. S.K Shukla, Advocate contacted him and introduced him to Mr. Naresh Chauhan and his son namely, Mr. Prashant Chauhan, Advocate.

Mr. Narayan Kumar Kashyap further submits that he was told by Mr. S.K. Shukla, Advocate, that Mr. Naresh Chauhan and Mr. Prashant Chauhan have some personal dispute with Mr. Sushil Chauhan, and that Mr. Narayan Kumar Kashyap may sign on the petition for filing a case against Mr. Sushil Chauhan, so that Mr. Naresh Chauhan and Mr. Prashant Chauhan can ultimately compromise the matter with Mr. Sushil Chauhan.

Mr. Narayan Kumar Kashyap further submits that he had only signed on the petition which was filed as a PIL. Further, he was not aware about

any further proceedings, being followed by Mr. S.K. Shukla, Advocate or Mr. Naresh Chauhan and his son, i.e., Mr. Prashant Chauhan, Advocate, subsequent to such signing of the PIL. Thus, he was totally in the dark about any further transaction being carried out by them, in any manner.

He further submits that he has not signed on the contempt petitions, i.e., CONT.CAS(C) 1355/2024 and CONT.CAS(C) 350/2025, though his signatures purportedly appear in the contempt petitions as well as the additional affidavits.

In this regard, he submits that his signatures are forged, and that he never signed the petitions, i.e., CONT.CAS(C) 1355/2024 and CONT.CAS(C) 350/2025 or the additional affidavits, which were filed subsequently in the present petitions.

The present set of facts bring forth a very serious matter, wherein, the process of the Court is being misused and abused for the purpose of exerting pressure on the owners of the properties wherein unauthorised construction exists, in order to extort money and earning money in an illegal manner.

Accordingly, considering the submissions made before this Court, the following directions are issued:

I. The matter is referred to the Bar Council of Delhi, for carrying out requisite investigation against Mr. S.K. Shukla, Advocate and Mr. Prashant Chauhan, Advocate, whose details are given hereinabove.

II. The Bar Council of Delhi would also contact Mr. Narayan Kumar Kashyap, whose details are given hereinabove, at the time of hearing, as it is the clear case of Mr. Narayan Kumar Kashyap that his signatures on the petitions filed before this Court, i.e., CONT.CAS(C) 1355/2024 and CONT.CAS(C) 350/2025, are forged and that he has never filed the said petitions.

III. The matter is also referred to the Deputy Commissioner of Police (“DCP”), South District, for carrying out appropriate proceedings against the aforesaid persons, whose details had been given hereinabove. Proper investigation, as per the procedure be done by the Police and appropriate proceedings, including, lodging of the First Information Report (“FIR”), etc., be carried by the Police.

IV. Needless to state, in case, during the course of investigation, the Police finds that other persons are also involved, appropriate action shall be taken by the Police against such persons as well.
