1. This is an application for grant of bail. The
applicants are shown as an accused in C.R.No.12/2006
registered by Borgaon Police Station for alleged
offences under Section 302, 325, 323, 506 read with 34
of the I.P.C. The deceased is one Dattatraya Pawar.
The allegations against the present applicants are that
they assaulted him and caused a depressed fracture.
There are two eye witnesses who are the ladies by names
Mangal and Sumitra. However, my attention was drawn to
the statement of Dr. Nikam who talks about the

complainant and two witnesses bringing the injured
Dattatraya to the hospital and giving history of
accident. Dr. Nikam has stated that the complainant
himself was injured and continued to remain sitting in

the rickshaw. The aforesaid two eye witnesses have also
stated that there was dispute between the parties on the
agriculture land and they are not in talking terms with
the accused. Taking an over all view of the matter, it
is directed that pending trial in pursuance of
C.R.No.12/2006 registered by Borgaon Police Station,
Satara, the applicants may be released on bail in the
sum of Rs.15,000/- each with one surety each in the like
amount subject to the condition that they should report
to the Investigating Officer once in a month on every
first Monday till the conclusion of the trial.
