1. This is an application for grant of bail. The applicant is shown as an accused in C.R.No.97/2005 registered by Pangari police station, Solapur for the offence punishable under Sections 302, 201, 304(b), 498-A r/w section 34 of IPC. From the record it appears to be the prosecution case that the deceased Trupti was married to the applicant on 15.7.2005. On the date of the incident i.e.

10.12.2005 Trupti was found burning in her house. The statements of 2 witnesses by name Mukund Patil and Shridhar Patil indicate that when they found smoke coming from the house, they attempted to enter the house but the doors of the house were locked from the inside. Statement of another witness Ramesh indicates that he went on motor cycle to Barshi to fetch the applicant and came back with the applicant. Post mortem notes indicates that the burn injuries were post mortem and the cause of death was asphyxia due to smothering. It may be possible that asphyxia may be caused due to smoke. In any case witnesses do not talk about any other assailants in or running away from the house. Taking an overall view of the matter, I am inclined to grant bail. It is therefore, directed that pending his trial in C.R.No.97/2005 the applicant may be released on bail in the sum

of Rs.15,000/- with one surety in the like amount subject to the condition that he will report to the concerned investigating officer once a month on every first Monday till the conclusion of the trial.
