ORDER:
This Criminal Petition is filed under Sec.482 Cr.P.C., by the Petitioner/Accused, seeking to quash the proceedings in Crime No.21 of 2016 on the file of Biccavole Police Station, East Godavari District, registered for the offence punishable under Section 380 IPC, against him.
No representation for the petitioner.
At the time of hearing, learned Assistant Public Prosecutor appearing for respondent No.1 State filed a memo stating that during investigation, the investigating agency referred the case as “Mistake of Fact” Vide C.No.18/SDPO-RCPM/2018, on 23.03.2018, and no orders are necessary and became infructuous. Learned counsel for respondent No.2 did not oppose the said submission.
In view of the said submissions, nothing survives in this criminal petition for adjudication.
Therefore, the Criminal Petition is dismissed as infructuous.
