आवेदकगण की ओर से धारा 528 भारतीय नागिरक सुर्षा संिहता के अन्तगर्त यह आवेदन प्ऴ , पिरवाद सं० 425/2024 (Kanya Devi Vs. Sarvesh & others), अंतगर्त धारा 452, 323, 504 भा०दं०िव०., थाना फतेहगंज पूवर्, जनपद बरेली में न्याियक मिजस ् ेट फरीदपुर, बरेली ्षारा पािरत तलबी/सम्मन आदेश िद० 11.12.2025 तथा इस वाद की संपूणर् कायर्वाही को अपास्त/खिण्डत करने हेतु योिजत िकया गया है।

आवेदकगण के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा को सुना गया एवं प्ऴावली पर उपलब्ध सामि्षयों का अवलोकन िकया गया।

आवेदकगण के िव्षान अिधव्वा ने तकर् ्ऺस्तुत िकया िक िवप्षी संख्या-2 ने न्याियक मिजस ् ेट, फरीदपुर, बरेली के न्यायालय के सम्ष धारा 156 (3) दंड ्ऺि्वया संिहता के तहत आदेश पािरत करने हेतु िदनांक 04.04.2023 को एक ्ऺाथर्ना प्ऴ ्ऺस्तुत िकया था। िव्षान न्याियक मिजस ् ेट फरीदपुर, बरेली ने पिरवाद के ्ऺकथनों पर िवचार करने के उपरांत, धारा 200 दंड ्ऺि्वया संिहता के तहत पिरवािदनी का बयान दजर् करने हेतु ितिथ िनयत की। पिरवािदनी का बयान िदनांक 08.10.2024 को दजर् िकया गया था, अथार्त् किथत घटना की ितिथ से 8 महीने बीत जाने के बाद। पिरवािदनी ने बयान िदया िक िदनांक 31.01.2023 को जब वह अपने बच्चों के साथ अपने घर पर थी, तब िवप्षीगण उसके घर में घुस आए और उसे पीटा तथा जान से मारने की धमकी दी। उन्होंने राजेश को भी पीटा जो उसे बचाने आया था। उसका िचिकत्सीय परी्षण नहीं कराया गया था। तत्प्ाात, किथत घटना के किथत गवाहों सुमन देवी और राजेश के बयान धारा 202 दंड ्ऺि्वया संिहता के तहत ्व मशः िदनांक 30.11.2024 और 03.10.2025 को दजर् िकए गए और उन्होंने अिभयोजन प्ष के कथनों का मुख्य रूप से समथर्न िकया है। िव्षान न्याियक मिजस ् ेट ने प्ऴावली पर उपलब्ध तथ्यों एवं सामि्षयों तथा संबंिधत पुिलस थाने ्षारा ्ऺस्तुत की गई आख्या पर िवचार करने के उपरांत, उ्व ्ऺाथर्ना प्ऴ को पिरवाद के रूप में माना तथा कायार्लय को इसे पिरवाद वाद के रूप में दजर्

करने का िनदरॏश िदया। उ्व पिरवाद वाद, पिरवाद वाद संख्या 425/2024 (कन्या देवी बनाम सवरॏश एवं अन्य) के रूप में दजर् िकया गया है तथा आदेश िदनांक 11.12.2025 के ्षारा आवेदकगण को सम्मन िकया गया । यहाँ यह उल्लेख करना ्ऺासंिगक है िक पिरवाद वाद के लंिबत रहने के दौरान, अिभयु्वा अनीता की मृत्यु िदनांक 21.03.2026 को हो गई। आगे यह भी कहा गया िक वास्तिवक तथ्य यह है िक पिरवािदनी के पिरवार और आवेदकों के बीच एक दीवानी िववाद चल रहा है। किथत गवाह राजेश उफर् राजेश कुमार सक्सेना िवप्षी संख्या-2 और उसके पिरवार की अवैध गितिविधयों का समथर्न करता है। राजेश कुमार सक्सेना उफर् राजेश ने किथत घटना िदनांक 31.01.2023 के संबंध में िदनांक 31.01.2023 को ही एक ्ऺ थम सूचना िरपोटर् दजर् कराई थी और वतर्मान आवेदकों को इस मामले में झूठा फंसाया था। ्ऺ थम सूचना िरपोटर् के कथनों के अवलोकन से यह स्प्ि है िक उसने न्यायालय के सम्ष धारा 202 दंड ्ऺि्वया संिहता के तहत िदए गए बयान की तुलना में एक िभन्न कहानी/वजर्न ्ऺस्तुत िकया है। यहां यह भी ्ऺासंिगक है िक िदनांक 11.12.2025 को िव्षान न्याियक मिजस ् ेट वाराणसी ने प्ऴावली पर उपलब्ध साष्यों का अवलोकन िकए िबना और िबना न्याियक मिस्तष्क का ्ऺयोग िकए, गलत एवं अवैध तरीके से इसें पिरवाद के रूप में दजर् कर आवेदकगण को उपरो्व धाराओं के अंतगर्त तलब िकया है। चूंिक, यह कारर्वाई भारतीय नागिरक सुर्षा संिहता के लागू होने के उपरांत की गई है। अतः ्ऺस्तुत मामलें में भारतीय नागिरक सुर्षा संिहता के अध्याय XVI में िनिहत ्ऺावधान ही लागू होंगे।

अपने तकॏल के समथर्न में, आवेदक के िव्षान अिधव्वा ने इस माननीय न्यायालय ्षारा Anibha Saini Vs. State of U.P,, (2024:AHC-LKO:83319) के मामलें में िदए गए िनणर्य पर भरोसा जताया। उ्व मामलें में न्यायालय के सम्ष यह ्ऺश्न था िक क्या सं्ञान लेने से पूवर् ही ्ऺस्तािवत अिभयु्वों को नोिटस जारी करने का मिजस ् ेट का आदेश Indian Bank Association & Ords. Vs. Union of India & Ors. (2014) 2 SCC (CRL 652) के िनणर्य के आलोक में अवैध था। माननीय उच्च न्यायालय ने भारतीय नागिरक सुर्षा संिहता की धारा 223 के परंतुक (proviso) का सं्ञान लेते हुए यह िटप्पणी की िक िव्षान मिजस ् ेट ्षारा ्ऺस्तािवत अिभयु्वों को सुनवाई का अवसर ्ऺदान करने हेतु नोिटस सही ्ऺकार से जारी िकया गया था। उ्व आदेश का ्ऺासंिगक अंश िनम्नवत् है:-

"Having heard learned counsel for the applicant, learned A.G.A. for the State and upon perusal of the record, it transpires that a private complaint came to be lodged by the applicant under Section 138 of the Negotiable Instruments Act which was registered on 14.08.2024. Admittedly, the new B.N.N.S., 2023 has come into force on 01.07.2024. Therefore, having regard to the aforesaid admitted facts, there cannot be any doubt as to the fact that the provisions contained in Chapter XVI of B.N.N.S., 2023, shall be applicable in the instant case. Therefore, having regard to the

provisions contained in Section 223 (1) of B.N.N.S., 2023, the impugned order dated 14.11.2024, whereby the notice has been issued to the proposed accused person after affording him an opportunity to be heard, cannot be said to be illegal."

इस स्तर पर, िव्षान अपर शासकीय अिधव्वा ने ्ऺितवाद िकया िक आ्षेिपत आदेश में कोई अवैधता नहीं है, क्योंिक घटना के लागू होने से पूवर् की है। अतः आ्षेिपत आदेश में कोई अवैधता या िवकृित नहीं है और वतर्मान आवेदन सारहीन होने के कारण खािरज िकए जाने योग्य है।

्ऺत्यु्तर में, आवेदक के िव्षान अिधव्वा का यह तकर् है िक आ्षेिपत आदेश अवैध एवं अन्यायपूणर् है और िनरस्त िकए जाने योग्य है।

उभय प्षों के िव्षान अिधव्वागण के परस्पर तकॏल को सुनने के उपरांत, इस न्यायालय का यह मत है िक चूंिक मामलें को िदनांक 11.12.2025 को पिरवाद (complaint case) के रूप में दजर् करते हुए आवेदकगण को सम्मन िकया गया है। इसिलए, वतर्मान मामलें में भारतीय नागिरक सुर्षा संिहता, 2023 के अध्याय XVI में िनिहत ्ऺावधान लागू होंगे।

BNSS की धारा 223 िनम्नवत् है:-

Examination of complainant.-(1) A Magistrate having jurisdiction while taking cognizance of an offence on complaint shall examine upon oath the complainant and the witnesses present, if any, and the substance of such examination shall be reduced to writing and shall be signed by the complainant and the witnesses, and also by the Magistrate:

Provided that no cognizance of an offence shall be taken by the Magistrate without giving the accused an opportunity of being heard:

Provided further that when the complaint is made in writing, the Magistrate need not examine the complainant and the witnesses-

(a) if a public servant acting or purporting to act in the discharge of his official duties or a Court has made the complaint; or

(b) if the Magistrate makes over the case for inquiry or trial to

another Magistrate under section 212:

Provided also that if the Magistrate makes over the case to another Magistrate under section 212 after examining the complainant and the witnesses, the latter Magistrate need not reexamine them.

भारतीय नागिरक सुर्षा संिहता की धारा 223 की उपधारा (1) का परंतुक (Proviso) यह अिधदेिशत (mandate) करता है िक मिजस ् ेट, पिरवाद पर िकसी अपराध का सं्ञान लेते समय, पिरवादी और उपिस्थत साि्षयों (यिद कोई हों) की शपथ पर परी्षा करेगा और उसे लेखब्ध करेगा। उ्व परंतुक आगे यह भी अिनवायर् करता है िक मिजस ् ेट अिभयु्व को सुनवाई का अवसर िदए िबना अपराध का सं्ञान नहीं लेगा। भारतीय नागिरक सुर्षा संिहता की धारा 227 आदेिशका जारी करने (issuance of process) से संबंिधत है, जो दंड ्ऺि्वया संिहता की धारा 204 के समान है।

अतः, उपयुर ् तथ्यों के आलोक में, चूँिक नया कानून अथार्त् भारतीय नागिरक सुर्षा संिहता 2023 िदनांक 01.07.2024 से लागू हो चुका है। इसिलए, पुराने कानून को लागू नहीं माना जा सकता। चूँिक, वतर्मान मामलें में ्ऺ करण िदनांक 11.12.2025 को पिरवाद (complaint case) के रूप में दजर् कर आवेदकगण को सम्मन िकया गया है। अतः मिजस ् ेट ्ष ारा अपराध का सं्ञान लेने से पूवर् अिभयु्व को सुनना आवश्यक है। तदनुसार, आ्षेिपत आदेश िदनांक 11.12.2025 उस सीमा तक अवैध है जहाँ मिजस ् ेट ने िनजी िवप्षी ्षारा दायर पिरवाद में आरोिपत अपराधों का सं्ञान, अिभयु्व -आवेदकों को सुनवाई का अवसर ्ऺ दान िकए िबना ही ले िलया।

उपरो्व तथ्यों और िववेचना के दृि्िगत, भारतीय नागिरक सुर्षा संिहता की धारा 528 के अंतगर्त ्ऺस्तुत वतर्मान आवेदन तदनुसार, स्वीकार (allow) िकया जाता है। ्ऺश्नगत आदेश िदनांक 11.12.2025 भारतीय नागिरक सुर्षा संिहता की धारा 223 के ्ऺावधानों का उल्लंघन करता है। अतः इसे एत्द्वारा िनरस्त िकया जाता है।

्ऺकरण को न्याियक मिजस ् ेट, वाराणसी को इस िनदरॏश के साथ ्ऺित्ऺेिषत (remit) िकया जाता है िक वे ऊपर की गई िटप्पिणयों को ध्यान में रखते हुए, िविध के अनुसार नवीन आदेश पािरत करें।
