आवेदकगण की ओर से धारा 528 बी.एन.एस.एस. के अन्तगर्त यह आवेदन प्ऴ, पिरवाद सं० 2433/2016 अतंगर्त धारा 323, 452, 504, 506 भा०दं०िव०, थाना िपलखुआ, िजला हापुड़, जो न्याियक मिजस ् ेट-्ऺथम हापुड़ के न्यायालय में लंिबत है, में उभय प्ष के मध्य समझौतानामा, िदनांिकत 05.02.2026 के आधार पर इस मामलें की संपूणर् कायर्वाही को अिभखिण्डत करने हेतु योिजत िकया गया है।

िवप्षी सं० 2 की ओर से िव्षान अिधव्वा ्शी गरूणध्वज पाण्डेय की ओर से वकालतनामा दािखल िकया जाय।

आवेदकगण के िव्षान अिधव्वा, िवप्षी सं० 2 के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेदकगण के िव्षान अिधव्वा का कथन है िक प्षकारों के मध्य आपस में सुलहसमझौता हो गया है तथा वे इस वाद को आगे नहीं चलाना चाहते हैं। इसिलए, उपरो्व वाद की संपूणर् कायर्वाही को अपास्त कर िदया जाय। अपने तकर् के समथर्न में उन्होंने माननीय उच्चतम न्यायालय ्षारा Gian Singh Vs. State of Punjab, 2012 AIR SCW 5333, B.S. Joshi and others Vs. State of Haryana, (2003) 3 SCC 675, Narinder Singh & Ors Vs. State of Punjab & Anr. 2014 Law Suit (SC) 202, Yogendra Yadav & Ors Vs. State of Jharkhand & Anr, Dimpey Gujral W/o Vivek Gujral & Ors Vs. Union Territory & Ors में पािरत नजीरों की ओर न्यायालय का ध्यान आकृ्ि कराया। उनका यह भी कथन है िक प्षकारों के बीच हुए समझौतानामा को सत्यािपत करने हेतु िवचारण न्यायालय में ्ऺस्तुत िकया गया तथा संबंिधत िवचारण न्यायालय की आदेश िद० 01.05.2026 (अनुलग्नक-5) के ्षारा समझौता तस्दीक िकया जा चुका है, जो प्ऴावली पर उपलब्ध है।

िवप्षी सं० 2 के िव्षान अिधव्वा उपयुर ् तथ्यों से सहमत है।

प्ऴावली पर उपलब्ध साष्यों एवं उभय प्ष के िव्षान अिधव्वागण को सुनने तथा प्ऴावली एवं माननीय उच्चतम न्यायालय की उपरो्व नजीरों का पिरशीलन करने के प्ाात् धारा 528 भारतीय नागिरक सुर्षा संिहता के अन्तगर्त ्ऺस्तुत िकया गया यह आवेदन प्ऴ स्वीकार िकए जाने योग्य है।

तद्नुसार, यह आवेदन प्ऴ स्वीकार िकया जाता है तथा उपरो्व विणत वाद की संपूणर् कायर्वाही अिभखिण्डत (Quashed) की जाती है।

इस वाद में यिद कोई अन्तिरम आदेश हो तो उसे समाप्त समझा जाय।

कायार्लय को िनदरॏश िदया जाता है िक इस आदेश की एक ्ऺितिलिप संबंिधत न्यायालय को अिवलम्ब भेजना सुिनि्ात करें।
