आवेदकगण की ओर से धारा 528 भारतीय नागिरक सुर्षा संिहता के अन्तगर्त यह आवेदन प्ऴ , पिरवाद सं० 18250, वषर् 2024 (राज्य जिरए रिवन ् नाथ बनाम राजेन ् िनषाद) , अन्तगर्त धारा 323, 504, 506 भा०दं०िव०, थाना झगहा, िजला गोरखपुर, में अपर िसिवल न्यायाधीश (िस०िड०) कोटर् नं० 3/अपर मुख्य न्याियक मिजस ् ेट गोरखपुर ्षारा पािरत सम्मन आदेश िदनांक 10.09.2025 को अपास्त करने हेतु योिजत िकया गया है।

आवेदकगण के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेदकगण के िव्षान अिधव्वा का कथन है िक िवप्षी सं० 2 ्षारा दुराशय के तहत वतर्मान पिरवाद दजर् कराया गया, जबिक िविदत है िक उभय प्ष के मध्य भूिम िववाद है तथा उसी के रंिजशन इस मामलें में आवेदकगण को फंसाय गया है। आगे यह भी कहा गया िक इस ्ऺ करण में उभय प्षकारों के मध्य सुलह-समझौता हो जाने की संभावना है। इसिलए, इस ्ऺ करण को संबंिधत अवर न्यायालय के मध्यस्थता केन ् को स्थानान्तिरत कर िदया जाय।

िव्षान अपर शासकीय अिधव्वा का तकर् है िक उनका यह अनुरोध स्वीकार िकए जाने में कोई आपि्त नहीं है।

प्ऴावली के पिरशीलन एवं उपयुर ् तथ्यों के दृि्िगत इस ्ऺकरण में यह िनदरॏिशत िकया जाता है िक दोनों प्षकार संबंिधत अवर / िवचारण न्यायालय के सम्ष उपिस्थत होकर मामलें को सुलह-समझौता के ्षारा िनस्तािरत करने के िलए आवेदन प्ऴ ्ऺस्तुत करें। यिद, ्ऺकरण को सुलह-समझौता के आधार पर िनस्तािरत करने के संबंध में आवेदन प्ऴ , अवर / िवचारण न्यायालय के सम्ष ्ऺस्तुत िकया जाता है तो संबंिधत न्यायालय ्षारा आवेदन प्ऴ ्ऺस्तुत िकए जाने की ितिथ से एक सप्ताह के अंदर उस पर उिचत आदेश पािरत िकया जाय तथा संबंिधत
