आवेदकगण की ओर से धारा 528 भारतीय नागिरक सुरक्षा संिहता के अन्तगर्त यह आवेदन पत्र, वाद सं० 1388 सन 2015 अन्तगर्त धारा 323, 504, 506 भा०दं०िव०, थाना िबलिरयागंज, िजला आजमगढ़़़़़़़़़़़़़़़़़़़़ में अपर मुख्य न्याियक मिजस्ट्रेट कोटर् न. 11, आजमगढ़़़़़़़़़़़़़़़़़़़ के न्यायालय में लिम्बत है जो की न्याियक मिजस्ट्रेट कोटर् न. 25 द्वारा पािरत प्रश्नगत/तलबी आदेश िद० 28.02.2015 को अपास्त करने के उद्देश्य से योिजत िकया गया है।

आवेदकगण के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदकगण के िवद्वान अिधवक्ता के तकों को श्रवणोपरान्त, पत्रावली के पिरशीलन से न्यायालय ने पाया िक पिरवाद में लगाए गए आरोप एक संज्ञेय अपराध के कमीशन का खुलासा करते हैं एवं वह आरोप, िकए गए िववेचना/ अवलोकन के उपरान्त लगाए गए हैं। उन आरोपों को इस न्यायालय द्वारा धारा 482 दं०प्र०सं०/धारा 528 बी.एन.एस.एस. के तहत अपनी शिक्त का प्रयोग करते हुए, जॉच के दौरान एकत्र की गयी सामग्री के आरोपों की शुद्धता और िवश्वसनीयता का आकलन करने की आवश्यकता नहीं है। इस स्तर पर आवेदकगण / अिभयुक्तगण के िववािदत बचाव पर िवचार नहीं िकया जा सकता है। तद्नुसार, प्रसंज्ञान या उपरोक्त वाद की कायर्वाही को रद्द करने की प्राथर्ना और पिरणामी कायर्वाही अस्वीकृत की जाती है।

इस स्तर पर, आवेदकगण के िवद्वान अिधवक्ता का अनुरोध है िक आवेदकगण को अभी तक उपरोक्त मामलें में िगरफ्तार नहीं िकया गया है और पुिलस आवेदकगण को िगरफ्तार करने के प्रयास में है और संबंिधत िवचारण न्यायालय द्वारा आवेदकगण के िखलाफ दण्डात्मक प्रिक्रया जारी की जा सकती है। इसिलए, आवेदकगण के जमानत आवेदन पत्र पर िवचार करने के िलए

यहां प्रासंिगक है िक माननीय उच्चतम न्यायालय द्वारा Satendra Kumar Antil Vs. Central Bureau of Investigation and another (Special Leave to Appeal (Crl.) No. 5191 of 2021 के प्रकरण को आदेश िद० 07-10-2021 द्वारा पहले ही जमानत हेतु िदशा-िनदेर्श देते हुए िनस्तािरत िकया जा चुका है, इसके पश्चात् अब संबंिधत िवचारण न्यायालय को जमानत देने के िलए उनके िववेक और िवचार को िनयंित्रत करने वाले वैधािनक प्रािवधानों को प्रभािवत िकए िबना, इस न्यायालय द्वारा कोई िविशष्ट िनदेर्श जारी करने की आवश्यकता नहीं है, क्योंिक यह अपेक्षा की जाती है िक संबंिधत िवधारण न्यायालय आवेदकगण के जमानत प्राथर्ना पत्र को िनस्तािरत करते सगय माननीय उच्चतम न्यायालय द्वारा पहले से जारी आवश्यक िदशा-िनदेर्शों को ध्यान में रखेगा।
