आवेदक की ओर से धारा 528 भारतीय नागिरक सुर्षा संिहता के अन्तगर्त यह आवेदन प्ऴ, वाद सं० 765/2022 (संध्या दूबे व आिद बनाम पंकज दूबे), अंतगर्त धारा 125 दं०्ऺ०सं०, थाना िसगरामऊ, जनपद जौनपुर में अपर ्ऺधान न्यायाधीश-्ऺथम, पािरवािरक न्यायालय, जौनपुर ्षारा पािरत ्ऺश्नगत आदेश िदनांक 28.03.2026 तथा आदेश िदनांक 02.05.2026 के ्षारा िनगर्त िरकवरी वारण्ट के िवरू्ध योिजत िकया गया है।

आवेदक के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधकता को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेदक के िव्षान अिधव्वा का कथन है िक संबंिधत अपर ्ऺधान न्यायाधीश, पािरवािरक न्यायालय ्षारा िवप्षी सं० 02 का भरण-पोषण ्ऺाथर्ना प्ऴ अंतिरम रूप से स्वीकार करते हुए िवप्षी सं० 02 को ्ऺाथर्ना प्ऴ ्ऺस्तुत करने की ितिथ से धनरािश अंकन 3000/- रूपये ्ऺितमाह भरण पोषण अदा करने का आदेश पािरत िकया गया है, िकतु ्ऺश्नगत पािरत आदेश न्यायोिचत नहीं है, क्योंिक उ्व आदेश पािरत करते समय आवेदक की आय व आय के ्शोत पर ध्यान नहीं िदया गया, िनगरानीकतार् की आय इतनी नहीं है िक वह भरण-पोषण की उ्व धनरािश िवप्षी सं० 02 को अदा कर सकें। आगे उनके ्षारा यह भी अनुरोध िकया गया िक ्ऺश्नगत आदेश के अनु्वम में अब तक के बकाया धनरािश को िकश्तों में भुगतान हेतु िनदरॏिशत कर िदया जाय।

िव्षान अपर शासकीय अिधव्वा ्षारा यह तकर् ्ऺस्तुत िकया गया िक अिभयु्व ्षारा िवचारण न्यायालय ्षारा पािरत ्ऺश्नगत आदेश का अनुपालन नहीं िकया जा रहा है, इसके कारण आवेदक के िवरू्ध िरकवरी वारण्ट में िनगर्त िकया जा चुका है। इसिलए, यह आवेदन प्ऴ िनरस्त िकये जाने योग्य है।

िनदरॏिशत िकया जाता है िक ्ऺश्नगत आदेश के अऩुपालन में अब तक के संपूणर् बकाया धनरािश को चार (04) बराबर िकश्तों में िवप्षी सं० 02 को अदा करें।

आवेदक ्षारा बकाये की पहली िकश्त िद० 10-06-2026 तक तथा दूसरी िकश्त िद० 1007-2026, तीसरी िकश्त िद० 10-08-2026, तक तथा चौथी िकश्त िद० 10-09-2026 तक अदा की जाएगी तथा ्ऺश्नगत आदेश में िनयत धनरािश अंकन 3,000/- रूपये ्ऺितमाह आवेदक ्ष ारा िवप्षी सं० 02 को भरण-पोषण भ्ते के रूप में दी जाने वाली धनरािश भी अब से आगे ्ऺ ितमाह िनयिमत रूप से अदा की जाएगी।

यिद आवेदक ्षारा बकाये की उ्व धनरािश िकश्तवार तथा िवप्षी सं० 02 को रू० 3,000/- ्ऺ ितमाह की िनयिमत अदायगी की जाती है तो ्ऺश्नगत आदेश के अनुपालन में वसूली की कायर्वाही स्थिगत रहेगी, िकन्तु यिद आवेदक ्षारा इस आदेश के अनुसार िनयत समयानुसार बकाया धनरािश की अदायगी नहीं की जाती है तथा ्ऺितमाह भरण-पोषण िदए जाने हेतु िनयत की गयी रू० 3,000/- की धनरािश ्ऺितमाह अदा नहीं की जाती है, तो यह अंतिरम आदेश स्वतः िनष ् भावी समझा जाय।

संबंिधत िवचारण न्यायालय को िनदरॏिशत िकया जाता है िक उ्व वाद का अंितम रूप से िनस्तारण आज से 04 माह के अन्दर, उभय प्ष को सुनवाई का समुिचत अवसर ्ऺदान करते हुए Crl. Appeal No. 730 of 2020, arising out of SLP (Crl.) No. 9503 of 2018 (Rajnesh vs. Neha & Anr.) में माननीय उच्चतम न्यायालय ्षारा ्ऺितपािदत िविध-्ि वस्था के ्ऺकाश में, इस न्यायालय के इस आदेश के िकसी भी िटप्पणी से ्ऺभािवत हुए िबना, गुण-दोष के आधार पर कर िदया जाय।

यहाँ पर यह स्प्ि िकया जाता है िक इस न्यायालय के अन्तिरम आदेश के अनुपालन में आवेदक ्ष ारा जो भी धनरािश िवप्षी सं० 02 को अदा की जाती है, वह धनरािश संबंिधत िवचारण न्यायालय ्षारा पािरत अंितम आदेश के अनुसार िनयत की गयी भरण-पोषण भ्ते की धनरािश में समायोिजत की जाएगी।

तद्नुसार, यह आवेदन प्ऴ अिन्तम रूप से िनस्तािरत िकया जाता है।
