The petitioner has preferred the present petition inter-alia with the following prayers:-

"(a) issue a writ, order or direction in the nature of mandamus and direct the respondents to consider and concede admission of Anurag Yadav, the ward of petitioner, in Class VI in Jawahar Navodaya Vidyalaya, Ghazipur during academic session 2022-23 within a specified time frame.

(b) issue a writ, order or direction in the nature of mandamus and direct the respondents to consider the representation of petitioner dated 5.11.2022 (Annexure '6') and concede admission of Anurag Yadav, the ward of petitioner, in Class VI in Jawahar Navodaya Vidyalaya, Ghazipur during academic session 2022-23 within a specified time frame."

It is argued by Shri Rajesh Tripathi, learned counsel appearing on behalf of respondent nos. 1, 2 & 4 that the identical controversy has already been decided by this Court in Writ C No. 39732 of 2022 (Ayush and another vs. Union of India and another) decided on 17.01.2023. Order reads as follows:-
