Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
The petitioners have preferred the present writ petition with the following prayer:-
"(i) Issue a writ, order or direction in the nature of Certiorari quashing the impugned order dated 09.01.2023 so far as relates to the direction to hold the election of the Committee of Management of the M.M. Inter College on the basis of approved list of society;
(ii) Issue a writ, order or direction in the nature of Mandamus directing the D.I.O.S. to direct the Election Officer to hold the election of the Committee of Management of the M. Inter College excluding 34 discarded members as per the order of the then D.I.O.S. dated 24.08.1998 and 22.12.2009 passed by Regional Level Committee;"
Today when the matter is taken up, it is very fairly argued by Sri Nipun Singh, learned counsel for the petitioners election programme has already been published, hence the present petition become infructous and prays for withdrawal of the present writ petition liberty to file fresh petition when the election is over raising all his grievances. Prayer, as made, is accepted.
Accordingly the present writ petition is dismissed as withdrawn with liberty as prayed.
