The prayer made in the present petition is for a direction to the respondents to pay compensation on account of acquisition of land.

The stand taken by learned counsel for the respondents is that the land was initially recorded in the name of the predecessor in interest of the petitioners. However, he had sold the same during his life time. Thereafter civil suits were filed challenging the sale deed, i.e., Suit Nos. 329 of 2020, 332 of 2020, 340 of 2020 and 330 of 2020 which are stated to be still pending. He further submits that in view of the aforesaid facts, the dispute has to be referred to the Court of competent jurisdiction under Section 3-H (4) of the Act and the needful shall be done within a period of three months from the date of receipt of copy of this order.

After hearing learned counsel for the parties, the present writ petition is disposed of with a direction to the respondent no. 2 to refer the dispute regarding entitlement of compensation on account of acquisition of land to the Court of competent jurisdiction within a period of two months from the date of receipt of copy of this order.
