Heard learned counsel for the petitioner and the learned Standing Counsel for the respondents.

The present petition has been filed for a direction upon the Board to consider the claim of the petitioner's institution as an examination centre in the forthcoming Board Examination, 2018.

It was pleaded that the petitioner institution was wrongly denied appointment as an examination centre and another institution, namely, Government Inter College, Arjunpur Garah, Fatehpur, was wrongly appointed as examination centre when, in fact, it was debarred in the year 2012 from being appointed as examination centre.

By order dated 22.12.2017, this Court had called for instructions from the Board to explain as to how a debarred institution was appointed as examination centre.

Pursuant to the order dated 22.12.2017, the District Inspector of Schools, Fatehpur has supplied written instructions to the learned Standing Counsel. In paragraph 5 of the written instructions, it is specifically stated that Rajkiya Inter College, Arjunpur Garah, Fatehpur was never put in the list of debarred educational institutions and that the statement that the said institution was debarred in the year 2012 is incorrect. In proof thereof, the list of institutions of the region concerned which were debarred in the year 2012 has also been supplied along with the written instructions.

In view of the above, since the Board Examinations are to commence from 1st week of February, 2018 and no institution can claim as of right that it be appointed examination centre, this Court finds no good reason to entertain this petition. The same is accordingly dismissed .
