An amendment application has been filed today, which is taken on record.

In view of the petition being disposed of on the ground of availability of alternative remedy, the amendment application need not be addressed and the same is accordingly rejected.

Heard Sri P.N. Saxena, learned Senior Counsel, assisted by Sri Ratnesh Kumar Pandey, for the petitioners; learned Standing Counsel for the respondents 1 to 3; Sri Ved Byas Mishra for the respondents 4 and 5; and Sri Arun Kumar for the respondent no.6.

The present petition has been filed challenging an order dated 15.12.2017 passed by the Vice Chancellor, Sampoornanand Sanskrit Vishwavidyalaya Varanasi, under Section 2(13) of the U.P. State Universities Act read with Statutes XII (7) of Statutes of the University, whereby recognition to Committee of Management, headed by the respondent no.6, in respect of Degree College affiliated to the University, has been accorded.

It is not in dispute that against the impugned order a reference would lie to the Chancellor under Section 68 of the U.P. State Universities Act.

In view of the above, the petition is disposed of with liberty to the petitioner to avail the remedy under Section 68 of the U.P. State Universities Act. It is expected that if recourse is taken to the alternative remedy under Section 68 of the aforesaid Act, then expeditious consideration shall be provided.
