The petitioners had appeared in the Intermediate Examination, 2017 conducted by the Board of High Schools and Intermediate Education and were declared fail on account of being absent in the practical examination of Chemistry paper.

The case of the petitioners is that they had participated in the practical examination but were wrongly denied marks for the same and in support of their case the Principal of the College concerned has submitted a representation to the Board. It is thus the prayer of the petitioners that the respondents be directed to add the marks of practical examination relating to subject Chemistry in their Intermediate Examination, 2017 result.

The learned Standing Counsel, who represents the respondents 1 and 2, has submitted that in case the petitioners make a comprehensive representation to the second respondent (Secretary, Madhyamik Shiksha Parishad, U.P. at Allahabad), then, after calling for report from the concerned authorities, appropriate decision can be taken.

In view of the above, without expressing any opinion on the merits of the claim of the petitioners, this petition is disposed of by giving liberty to the petitioners to make a comprehensive representation before the second respondent. If any such representation is filed, within 10 days from today, along with certified copy of this order as also documents to disclose that the petitioners had appeared for the practical examination concerned, the second respondent shall call for report from the concerned persons and thereafter shall take an appropriate decision in the matter, preferably, within a period of four weeks from the date of filing of such representation.
