Sri Mangla Prasad Rai, who has appeared on behalf of the respondents 1 and 2, states that this petition has become infructuous because the Vice Chancellor has already taken a decision pursuant to the inquiry report.
In view of the above, the learned counsel for the petitioner prays to withdraw this petition with liberty to file a fresh petition challenging the order which may have been taken pursuant to the inquiry report.
The petition is accordingly dismissed as withdrawn with liberty as prayed for.
