Heard learned A.G.A. for the State and perused the record.
The apellant-Munni Giri has filed this appeal against the judgment and order dated 11.1.1991 passed by Additional Sessions Judge / Special Judge, E.C. Act, Budaun in Sessions Trial No.257 of 1988 (State Vs. Sarnam Giri and others), Police Station- Ujhani, DistrictBudaun, whereby the appellant has been convicted under Section452 IPC to undergo six months rigorous imprisonment and to pay a fine of Rs.200/- and in default of payment of fine to undergo one month rigorous imprisonment and further convicted and sentenced the appellant under Section 307 IPC to undergo five years rigorous imprisonment and to pay a fine of Rs.1000/- and in default of payment of fine to undergo six months additional rigorous imprisonment.
The report of CJM-Budaun dated 18.1.2018, which is on record on this appeal indicates that Munni Giri, sole accused appellant in this appeal has since expired in the year 2015.
In view of above, this appeal stands abated.
The appeal is accordingly dismissed as such.
