others before the Hon’ble Court, for his

| promotion, in which, in compliance of |
| Hon’ble Court’s order dated 24.4.2017, the |
petitioner was given promotion from the
|
post of Assistant Teacher, Primary School to
the post of Head Master, Primary School, in
spite of his first promotion, after the three
years, the petitioner again filed present writ
petition
before
the
Hon’ble
Court.
On |
| considering his application, it reveals that |
petitioner is came under the category of
physical challenged person (Group C) i.e.
locomotive disability. As per the roaster of
reservation of physically challenged in the
District, the petitioner is placed at serial no.
75, in the district, in earlier years of 2020-
21, 10 promotions were done, thus due to
promotion of the petitioner is not come |
under the zone of consideration. The copy
of list of physically challenged persons of
the Districts is being annexed as Annexure
No. CA-1 to this affidavit.”
Learned Standing Counsel has also |
| referred to para 11 of the counter affidavit |
| where it has been stated that there are |
many senior teachers to petitioner serving
|
| in District Champawat who are entitled to |
| benefit of reservation. |
| Mr. N.P. Sah, learned Standing |
Counsel appearing for the State, fairly
submits that petitioner would be promoted
at his turn as per seniority. |
| Since criteria of promotion to the |
| post of Head Master in Junior High Schools |
is
seniority
subject
to
fitness
and, |
| admittedly, there are senior persons than |
the petitioner who are entitled to promotion
|
under the Rights of Persons with Disabilities
Act,
2016,
therefore,
writ
petition
