Petitioner has challenged an order passed by Trial Court on 22.2.2022. By the said order, learned Trial Court issued notice to defendant inviting objection to petitioner’s temporary injunction application. A coordinate Bench of this Court granted interim order on 3.3.2022 directing the parties to maintain status quo qua the suit property. Mr. Nagesh Aggarwal, learned Counsel appearing for the respondent (defendant in the suit), submits that his client has submitted objection to the temporary injunction application and also filed written statement to the plaint and, therefore, temporary injunction application can be decided by the Trial Court. Mr. Siddhartha Singh, learned Counsel appearing for the petitioner, also submits that writ petition may be disposed of by directing the Trial Court to decide petitioner’s temporary injunction application on any date to be fixed by this Court.
