Applicant, who is in jail in connection with FIR No. 38/2014 relating to offences punishable under Sections 392 IPC and Section 3/(11)(1) Uttarakhand Protection of Cow Progeny Act 2007, Police Station Gadarpur, District Udham Singh Nagar, has sought his release on bail.
Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.
For the reasons stated in the bail order dated 16.10.2014 of the co - accused Shavej and Israil, with similar role, the applicant, who is in jail since 12.9.2014, is entitled to bail on the ground of parity. Bail application of the applicant is allowed. Let the accused-applicant be enlarged on bail on his executing a personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Magistrate concerned.
