Applicant, who is in jail in connection with Case Crime No. 75 of 2014 relating to offences punishable under Sections 420, 468, 471, 472, 411 and 34 IPC, Police Station Dalanwala, District Dehradun has sought his release on bail.
Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.
An FIR was lodged by the informant against Ranvir Singh in connection with offences punishable under Sections 420, 468, 471, 472, 411 and 34 IPC. Allegedly the owner of the vehicle Ranvir Singh in the pseudonym of Pankaj Dwivedi sold the car to the informant, who got the same enquired from Regional Transport Officer, only to find that the applicant was not the owner and the said registration number did not belong to a car, but to a scooty.
Present applicant alongwith co-accused Subhash Dwivedi were arrested together on 29.3.2014. Co-accused has been granted bail by this court vide order dated 16.7.2014. Applicant is in jail since 29.3.2014 and has no previous criminal history.
Considering the facts of the case and attenuating circumstances, this court is of the opinion that the applicant should be enlarged on bail. Let the applicant be enlarged on bail on his executing a personal bond and furnishing two sureties, of the like amount to the satisfaction of Chief Judicial Magistrate, Dehradun.
