Applicant, who is in jail in connection with case crime no. 79 of 2013, under Sections 419, 420, 467, 471, 120B IPC, police station, Cantt. Dehradun, District Dehradun, has sought his release on bail.

Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.

Counter affidavit is taken on record.

It is the statement of learned counsel for the applicant that the applicant is ready to deposit a sum of Rs. 4.5 lacs (loan amount alongwith interest) in Central Bank of India.

Taking into account said submission of learned counsel for the applicant, as also attenuating circumstances, this Court is of the opinion that the applicant, who is in jail since 10.07.2013, should be granted bail, subject, of course, to the condition that if the applicant is unable to deposit the loan amount alongwith interest, it will be open for the prosecution to move for cancellation of bail before this Court.

Considering the entire conspectus of things, bail application is allowed.

Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of CJM, Dehradun, subject to the condition that if the applicant is unable to deposit the loan amount alongwith interest in Central Bank of India within a reasonable time, it will be open to the prosecution to move for cancellation of bail before this Court.

The above statement of learned counsel for the applicant shall have no bearing on the merits of the trial going on against the applicant before the court below.
