This is an application seeking regular bail in FIR No. 30 of 2013 under Section 417, 419, 420, 467, 468, 471 & 120B IPC police Station Pant Nagar, District Udham Singh Nagar.
Learned counsel for the applicant submits that applicant is in judicial custody with effect from 28.02.2013; all the offences are triable by Magistrate; Malkeet Singh @ Sonu Kachura had been appearing before the court below and present applicant is never known as “Sonu Kachura” nor present applicant was involved in any crime nor present applicant was ever arrested or released on bail earlier and in fact, Malkeet Singh @ Sonu Kachura was arrested and enlarged on bail and his sureties produced him before the trial court while withdrawing the sureties.
Considering the totality of facts and circumstances of the case, bail application is allowed. Let the applicant be released on bail on his furnishing a personal bond of ` 50,000/and two sureties, of the like amount to the satisfaction of trial court.
