Heard Sri Krishna Shanmugam, learned counsel for the petitioner, Sri Dilip Kumar Bommana, learned Assistant Government Pleader for Stamps and Registration, who is representing respondent Nos.1 and 2 and Sri Abu Akram, Iearned Standing Counsel for Telangana State Waqf Board, who is representing respondent No.3.

Aggrieved by the action of the Registering Authority in refusing to receive the document presented by the petitioner for registration in respect of plot bearing No.255/B, admeasuring 145 square yards, located in Sy.Nos.2gg, 2gO, 292, 293, 294 (parts) and Sy.Nos.2gt, 306 and 309 of Neredmet, Ma-lkajgiri Village and Grampanchayat, Ranga Reddy District, the present Writ Petition is filed.

Learned counsel for the petitioner submits that the document presented by the petitioner for registration was not entertained by the Registering Authority for the reasons best known to it. Learned counsel also states that no reasons were

Learned Standing Corttrsel for^{the TelanganaState Waqf} Board submits that the^{pI'opcrty in questionappearsto be in} prohibitory list falling u'ithin the ambit^{of Sectron 22-A of the} Registration Act, 1908 atrd therefore,^{necessary directions} may be issuerl to thc Sub^{Registrar concernedto verifyand} proceed with.

"Reasons for rellsal to register to be recorded--

(1) Every Sub-Registrar rcfusing to register^{a document,} except on the ground that^{the property lo whichit} relates is not situate within his^{sub district, shall} make an order of refusal^{and record his reasons for} such order in his Book^{No. 2, and endorse the words} "registration refused" on the^{document;and, on} application made by any person^{executing or} claiming under the document, shall,^without payment and unnecessary delay,^give him^{a copyof} the reasons so recorded.

(2) No registering officer shall accept for registration^a document so endorsed unless^and until,^underthe provisions hereinafter contained, the document^is directed to be registered."

7 . The Registering Authority is not empowered to^refuse registration of document/ s except under the^{circumstances} mentioned under the Registration Act,¹⁹⁰⁸ and^{the Rules} made thereunder. A1so, as^per the^versionof the^petitioner, no reasons were assigned for not entertaining^{the document} which was presented for registration^{by him. Therefore, this} Court is of the view that directibns^{as prayedfor haveto be} given to the pubtic authority directing it to^{perform its} function as required under^iaw.
