ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents.

This writ petition is filed seeking a direction to the respondents to make payment of amount of Rs.6,35,797/- towards pending bills amount payable to late K.Samsundar Reddy with interest @ 18% per annum from the date of final bill, i.e., 1998 to the date of actual payment is made to the petitioner.

Now the learned counsel for the petitioner submits that payments were made on various dates with delay. He states that no interest is paid on the delayed payments. The learned Government Pleader relied on Clause 69 of A.P.D.S.S. and states that no interest is payable on the money due to the contractor and hence the contractor is not entitled to the interest. The learned Government Pleader further stated that the petitioner has not come up with succession certificate within time and the delay in payment cannot be attributed to the department. Further, the petitioner submitted a representation on 09.08.2006 stating that she would withdraw the cases pending in this Court.

In view of receipt of the amounts by the petitioner and in view of the representation dated 09.08.2006, this writ petition is closed recording the payments made to the petitioner.

There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any pending in this writ petition, shall stand closed.
