ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
This Writ Petition was filed challenging the order passed by the first respondent in proceedings Cr.No.5376/2009/CPE/G3, dated 02.06.2009 to the extent of imposing a condition for release of seized duty paid liquor on payment of value of the stock while compounding the offence and for a consequential direction to the respondents to release the duty paid stock to the petitioner without insisting payment of value of the stock.
It is represented by the learned Counsel on either side that similar and identical issue came up for consideration in Writ Petition Nos. 11651 of 2009 and Batch and the said Writ
Petitions were dismissed by order dated 18.02.2010. Following the decision of this Court in Writ Petition Nos. 11651 of 2009 and batch, dated 18.02.2010, the present Writ Petition is also dismissed in terms thereof.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
