ORDER:
Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
This Writ Petition was filed challenging the inaction on the part of the Government in rectifying the eligibility certificate, in conformity with the New Tourism Policy of 1998, and for a consequential direction to the respondents to issue revised eligibility certificate duly stipulating the duration of five years as the incentive period and accordingly extend the benefit of incentive of tax holiday or deferment, as the case may be, to the petitioner from 01.04.2004 to 31.03.2009.
This Court, by order dated 06.08.2009, directed the respondents to consider the benefit of incentive of tax holiday or deferment, as the case may be, to the petitioner in terms of the New Tourism Policy of 1998 for the period from 01.04.2004 to 31.03.2009, if the petitioner was otherwise eligible as per law and pass appropriate orders within a period of four weeks from that day.
When the aforesaid order was not complied with within the said period, the petitioner filed C.C.No.1375 of 2011, wherein the Commissioner of Tourism Department filed an affidavit stating that on 29.05.2014 the Government issued orders permitting the Commissioner of Tourism to issue revised eligibility certificate to the petitioner unit with effect from 01.04.2004 to 31.03.2009 in compliance with the orders of this Court and consequently the Tourism Department issued a letter on 30.05.2014 to the petitioner issuing a revised eligibility certificate with effect from 01.04.2004 to 31.03.2009. In that view of the matter, the Contempt Case was closed.
In view of the above, no further orders are necessary in the
present Writ Petition, and the same is accordingly closed. The miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
