Mirza Neelopher Vs Mohd. Zameer Ahmed

This Civil Revision Petition, under Article 227 of the Constitution of India, is directed against the order, dated 09.11.2009, in I.A.No. 702 of 2009, in O.P.No.432 of 2009, on the file of Family Court, City Civil Court, Secunderabad, whereunder and whereby, in the application filed for temporary injunction, notice was ordered to the respondent without granting any temporary injunction.

2. Heard both sides.

3. The petitioner, appearing Party-in-person, contended that she will argue the matter before the trial court and prove her case to get temporary injunction. In view of her submission, the trial court is directed to dispose of the injunction application filed by the revision petitioner within a period of one month from the date of receipt of a copy of this order in accordance with law. The respondent counsel repots no objection for the said

proposal. In view of the fact that the application has to be decided in accordance with law, till the disposal of the injunction petition the respondent shall not contract second marriage. The above observation made by this Court shall not be taken as a ground to grant injunction by the trial court.

4. Accordingly, the Civil Revision Petition is disposed of with the above direction. No costs.
