ORAL ORDER:
The grievance of the petitioner is against the action of the respondents 1 and 2 in not executing the Non-Bailable Warrants against the 3rd respondent, which were issued in 2004 by the VI Metropolitan Magistrate, Medchal, Cyberabad in MP No.1416 of 2003.
The 2nd respondent has filed a counter affidavit setting out the several steps taken to apprehend the 3rd respondent, pursuant to the warrants issued by the learned magistrate. It is stated that police constables were deputed to Kolkata on 20.8.2006, the last known place of residence of the 3rd respondent and on enquiries made with the help of local police in Kolkata, it was learnt that the 3rd respondent has temporarily migrated to New Delhi to evade the warrants. The answering respondent states that all efforts will be taken under law to apprehend the 3rd respondent pursuant to the warrants issued.
In the circumstances above, no further proceedings are warranted. The writ petition is dismissed. No costs.
