ORDER:
Petitioners are aggrieved by the orders of the 2nd respondent-The Special Deputy Collector, L.A., (Industries), Hyderabd, as regards payment of compensation for the lands acquired in an extent of Ac.6.13 gts. in Survey No.78 and Ac.5.05 gts. in Survey No.79 situate at Kurmalaguda village, Sarroornagar Mandal, Ranga Reddy District.
2. An award was passed on 15-07-2006 rejecting the petitioner’s competing claim and declaring that the 3rd respondent is entitled to the compensation being the original owner of the property acquired. The petitioners assail this decision on the grounds set out in this writ petition. As the impugned decision was taken within the spectrum of his Statutory discretion by the Land Acquisition Officer, under the provisions of the Land Acquisition Act (for short ‘the Act’), the petitioner, if aggrieved thereby may avail the statutory remedy, by seeking a reference to the Civil Court in respect of his claim, under Section 18 of the Act.
3. In the circumstances, the writ petition is rejected. The petitioner is relegated to pursue the alternative statutory remedy. No costs.
