The instant bail application under Section 483 BNSS has been filed by the petitioner in connection with FIR No.233/2026, registered at the Police Station Udhyog Nagar (Kota City), District Kota City wherein he is charged for offences punishable under Sections 8 and 20 of the NDPS Act.

Learned counsel for the petitioner submits that the recovery of 437 grams of cannabis/charas has been effected at the instance of the petitioner, which is less than the commercial quantity. Counsel submits that the petitioner is in custody since 21.04.2026 and after investigation, charge-sheet has been submitted. Counsel further submits that the petitioner is not having any criminal antecedents and no other case under NDPS case has been

registered against the petitioner and since the trial will take its own time to conclude, therefore indulgence of bail be granted to the petitioner.

Per contra, learned Public Prosecutor opposed the prayer made by counsel for the petitioner.

Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that the recovery of 437 grams cannabis/charas has been effected at the instance of the petitioner, which is less than the commercial quantity i.e. 01 Kilograms, hence, rider contained under Section 37 of the NDPS Act is not attracted in the instant case and also considering the fact that the petitioner is in custody since 21.04.2026 and after investigation the charge-sheet has been submitted and since the petitioner has no criminal antecedents and trial will take its own time to conclude, hence, without expressing any opinion on merits and demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS.

Accordingly, the instant bail application under Section 483 BNSS is allowed and it is ordered that accused-petitioner Ravi Kumar @ Nikky S/o Rajendra Kumar arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
