Matter comes up on an application (I.A. 1/2026) filed by the petitioner for taking the amended prayer on record.

Application stands allowed for the reasons stated therein. Amended prayer filed with the application is ordered to be taken on record.

The instant criminal misc. bail application under Section 483 BNSS has been filed by the petitioner in connection with the FIR No. 269/2025, registered at the Police Station Khairthal, District Khirthal-Tijara for the offences punishable under Sections 115(2), 126(2), 112(2) and 140(2) of BNS, 2023.

Learned counsel for the petitioner submits that the petitioner has not been named in the aforesaid FIR. Counsel further submits that the co-accused persons namely Abhishek @ Deva and Sukhram @ Sukka have already been granted indulgence of bail by

this Court vide order dated 16.10.2025 in S.B. Criminal Misc. Bail Application No. 12953/2025 connected with S.B. Criminal Misc. Bail Application No. 13581/2025. Counsel submits that the co-accused person namely Sandeep Kumar has also been granted indulgence of bail by the Co-ordinate Bench of this Court vide order dated 11.12.2025 in S.B. Criminal Misc. Bail Application No.15829/2025. Counsel submits that the injured-Mufeed has sustained six injuries out of which five injuries were found to be simple in nature and one injury was found to be grievous in nature and the same has been inflicted on his wrist, which is not a vital part of the body. Counsel submits that general omnibus allegations have been levelled against all the accused persons and no specific overt-act has been assigned to the petitioner. Counsel submits that the petitioner has been in custody since 29.03.2026 and after investigation, chargesheet has already been submitted. Counsel further submits that the trial will take its own time to conclude, therefore, indulgence of bail be granted to the petitioner.

Per contra , learned Public Prosecutor opposes the prayer made by counsel for the petitioner. 6. Heard and considered the submissions made at the Bar and perused the material available on record.

Considering the arguments put forward by learned counsel for the petitioner and looking to the fact that indulgence of bail has already been granted to the co-accused persons namely Abhishek @ Deva, Sukhram @ Sukka and Sandeep Kumar and the case of the present petitioner is at par with them and also looking to the fact that the petitioner has been in custody since 29.03.2026

and after investigation, charge-sheet has been submitted and the trial will take its own time to conclude, hence, without expressing any opinion on the merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS.

Accordingly, the instant bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Sanjay Kumar Bhedi S/o Heeralal, arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all dates of hearing, as and when called upon to do so.
