The instant bail application under Section 483 BNSS has been filed by the petitioner in connection with the FIR No.155/2026, registered at the Police Station Sri Madhopur, District Sikar wherein he is charged for the offences punishable under Sections 8, 21 and 22 NDPS.

Learned counsel for the petitioner submits that a joint recovery of 146.4 grams of Tramadol was effected at the instance of the petitioner and co-accused namely Anil, who has already been granted indulgence of bail by the Co-ordinate Bench of this Court vide order dated 01.07.2026, while deciding S.B. Criminal Misc. Bail Application No.8325/2026. Counsel further submits that the petitioner does not have any criminal antecedents and no similar

case under NDPS Act is pending against him. Counsel submits that the petitioner is in custody and since trial will take its own time to conclude, therefore, indulgence of bail be granted to the petitioner.

Per contra, learned Public Prosecutor opposed the prayer made by counsel for the petitioner. 4. Heard and considered the submissions made at the Bar and perused the material available on the record. 5. Co-accused Anil has been granted bail by the Co-ordinate Bench of this Court while deciding S.B. Criminal Misc. Bail Application No.8325/2026 by passing the following order on 01.07.2026:

“1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 155/2026 registered atPolice Station Srimadhopur, District Sikar for the offences under Sections 8/21 and 8/22 of NDPS Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case under Sections 8/21 and 8/22 of NDPS Act. The recovery of tramadol from the petitioner's possession is 146.4 grams which is below commercial quantity. The petitioner is behind bars since long and the trial/investigation of the case may take considerable time, there are no criminal antecedents against the accused-petitioner, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

Heard and perused the material available on record.

Considering the arguments advanced by the learned counsel for the petitioner and looking to the fact that trial/investigation of the case may take considerable time, there are no criminal antecedents against the accused-petitioner, therefore, without commenting anything on the merits of the case, I

deem it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Anil S/o Sitaram, in connection with FIR No. 155/2026 registered at Police Station Srimadhopur, District Sikar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/-with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.”

Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that indulgence of bail has already been granted to the co-accused namely Anil by the Co-ordinate Bench of this Court while deciding S.B. Criminal Misc. Bail Application No.8325/2026 vide order dated 01.07.2026 and also looking to the fact that the case of the petitioner is at par with the case of co-accused Anil and there is no criminal antecedents of the petitioner and no similar case of NDPS Act has been lodged against the petitioner and since trial will take its own time to conclude, hence, without expressing any opinion on the merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS.

Accordingly, the instant bail application under Section 483 BNSS is allowed and it is ordered that accused-petitioner Amit Kumar S/o Shri Ramlal, arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the
