The instant anticipatory bail application under Section 482 BNSS has been filed by the petitioner apprehending his arrest in connection with FIR No.197/2023 registered at Police Station Kudgaon, District Karauli for the offences under Sections 143, 336, 365, 382 and 506 IPC.

Learned counsel for the petitioner submits that the injured has sustained simple and blunt injuries and during the course of investigation, the injured has submitted an affidavit in the form of compromise that on account of misunderstanding, the instant FIR has been registered against the petitioner, and now he does not want to prosecute the petitioner.

Counsel for the complainant supported the version of the counsel for the petitioner, but the Public Prosecutor opposed the prayer.

Considering the arguments put forward by learned counsel for the petitioner as well as learned counsel for the complainant and looking to the fact that the injured has sustained simple and blunt injuries and the complainant injured has entered into a compromise with the petitioner and without making any comments on merits and demerits of the case, this Court deems it just and proper to grant anticipatory bail to the petitioner.

Accordingly, the instant bail application under Section 482 BNSS is allowed and it is directed that in the event of arrest of the petitioner Pradhan S/o Ramnivas in connection with FIR No.197/2023 registered Police Station Kudgaon, District Karauli, he shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions:-

(i). that the petitioner/s shall make himself/herself available for interrogation by a police officer as and when required

¶20

(ii). that the petitioner/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and

(iii). that the petitioner/s shall not leave India without previous permission of the court.
