Petitioner has filed this bail application under Section 438 of Cr.P.C. in connection with F.I.R. No.404/2023, registered with the Police Station Kotkhawada, District Jaipur City(South) for the offence under Section 379 of IPC.

Counsel for the petitioner submits that the three phase motor alleged to have been stolen, has already been recovered from an open place. Counsel further submits that the petitioner is not required for any kind of recovery.

Learned Public Prosecutor has opposed the anticipatory bail application and submits that a criminal case is already pending against the petitioner.

Considered the submissions made by counsel for the petitioner as well as the learned Public Prosecutor.

Taking into consideration the allegations levelled against the petitioner and so also the fact that the stolen property has already been recovered from the open place, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to extend the benefit of anticipatory bail to the petitioner.

Accordingly, the Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Kotkhawada, District Jaipur City(South) in F.I.R. No. 404/2023 is directed that in the event of arrest of the petitioner he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:-

(I). that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and

¶25

(iii). that the petitioner shall not leave India without previous permission of the Court.
