Petitioner has filed this anticipatory bail application under Section 438 of Cr.P.C. arising out of F.I.R. No.647/2023 registered with the Police Station, Kumher, District Deeg for offence under Section 379 of IPC

Counsel for the petitioner submits that the petitioner has been implicated in this case with the allegations that the tractor & trolley loaded with bricks, which is said to have been stolen, were recovered from the Bada of the petitioner. Counsel further submits that the theft vehicle and material have already been recovered, hence, no further recovery is to be made from the petitioner. Counsel also submits that the petitioner is ready to join the investigation.

Learned Public Prosecutor has opposed the anticipatory bail application.

Learned Public Prosecutor on a query put up by the Court, has submitted that the tractor & trolley loaded with the bricks which were alleged to have been stolen, have already been recovered.

Considered the submissions made by counsel for the petitioner as well as the learned Public Prosecutor.

Taking into consideration the aforesaid fact, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to extend the benefit of anticipatory bail to the petitioner.

The Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Kumher, District Deeg in F.I.R. No. 647/2023 is directed that in the event of arrest of the petitioner he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:-

(I). that the petitioner shall make himself available for interrogation by a police officer as and when required;

¶24

(ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts

to the Court or any police officer, and

(iii). that the petitioner shall not leave India without previous permission of the Court.
